Samsung to petition US Supreme Court.
Samsung versus Apple…
If it seems like this battle has been going on for a long time, you’re correct. Since 2012, Samsung and Apple have been tying up the courts over their dispute.
Back in 2012, Samsung lost a patent lawsuit filed by Apple. Apple claimed Samsung infringed upon their intellectual property. Apple came out victorious and Samsung was ordered to pay Apple $548 million in damages.
Samsung recently filed a request with the US Federal Court of Appeals. In the request, Samsung asked for a new trial and $400 million of the awarded damages waived. The court rejected their request.
Samsung has now petitioned the US Supreme Court to hear their case. If SCOTUS does decide to hear the case, it will be the biggest showdown between two tech firms in US history. But if I were Samsung, I would get my checkbook ready. With the US Supreme Court only accepting 75 cases a year out of an estimated 10,000 petitions, it’s a very hopeful thought to think it will make it that far.
If Samsung is lucky enough to have their case heard, there is a precedent of cases involving patent infringements being overturned or having their awards being reduced significantly. So hang in there, Samsung, there might be a light at the end of tunnel.
